Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of LeMethodic (the "Service"), operated by Chadi Bakhay ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

LeMethodic is a French exam preparation platform offering speaking practice for the TCF, TEF, and DELF exams. The Service includes:

You must be at least 16 years old to use the Service. By creating an account, you represent that you are at least 16 and have the legal capacity to enter into these Terms.

4. Subscription, Free Trial, and Payment

4.1 Subscription Plans

LeMethodic offers a monthly subscription at $29 USD per month (subject to change with notice). Subscription grants access to the full diagnostic, curriculum, and feedback features. Some features (Sprint, Premium) are sold separately.

4.2 Free Trial

New subscribers are entitled to a 7-day free trial. You will not be charged during the trial. To avoid being charged, cancel before the trial ends. If you do not cancel, your subscription begins automatically and you will be charged the regular monthly fee.

4.3 Billing and Payment Processing

All payments are processed by LemonSqueezy, our Merchant of Record. By purchasing through the Service, you also agree to LemonSqueezy's terms of service. We do not see or store your payment card details.

Subscriptions auto-renew monthly until canceled. You can cancel at any time via your account settings or by contacting admin@lemethodic.com.

4.4 One-time Purchases

We may offer one-time products (e.g., Sprint Final at $199 USD, Premium at $499 USD). Pricing and availability are shown at checkout. One-time purchases grant time-bound or feature-bound access as described at the point of sale.

4.5 Promotions and Discount Codes

We may run promotional codes, referral discounts, or limited-time offers from time to time. These are subject to specific terms communicated at the time of the promotion. We may modify or end promotions at any time.

4.6 Taxes

Prices shown are exclusive of taxes unless otherwise stated. LemonSqueezy, as Merchant of Record, calculates and remits applicable taxes (VAT, GST, sales tax) based on your billing location.

5. Refund Policy

5.1 Subscription Refunds

You may cancel your subscription at any time. Cancellation stops future charges; we do not refund the current billing period after the trial has ended. If you cancel during your 7-day free trial, you will not be charged.

5.2 Sprint and Premium Refunds

For one-time products (Sprint, Premium), we offer a 14-day money-back guarantee: if you are not satisfied within 14 days of purchase, email us at admin@lemethodic.com to request a refund. After 14 days, refunds are at our discretion.

5.3 Refund Processing

Approved refunds are processed by LemonSqueezy and typically appear in your account within 5-10 business days, depending on your bank.

6. User Content

6.1 What You Submit

When you use the Service, you may submit content including audio recordings, written responses, and account information ("User Content").

6.2 Ownership

You retain all ownership rights to your User Content. We do not claim ownership of your recordings or written work.

6.3 License You Grant Us

You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, and display your User Content solely for the purpose of providing the Service to you. This license ends when you delete your User Content or close your account.

We do not use your User Content to train AI models. We do not share your User Content with third parties except as needed to provide the Service (e.g., sending audio to OpenAI for transcription, per our Privacy Policy).

You are responsible for your User Content. You agree not to submit content that:

The Service, including all methodology (Le Fond, Les Moules, Les Réflexes Anglais, Les Moules des Idées), curriculum content, software, design, branding, logos, and copy, is the exclusive property of Chadi Bakhay and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works of our content without written permission. Limited personal use as part of using the Service is permitted.

9. Feedback

If you provide feedback, suggestions, or ideas about the Service, we may use them without compensation or attribution. You waive any rights to such feedback.

10. Third-Party Services

The Service relies on third-party providers (LemonSqueezy, OpenAI, Anthropic, DigitalOcean, Vercel). Their terms and privacy practices apply to your interactions with them. We are not responsible for the actions or omissions of third-party providers.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy of feedback, or guarantee of exam results.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your breach of these Terms.

Upon termination, your right to use the Service ends immediately. Sections 5 (Refunds), 6.2-6.3 (Ownership/License), 8 (Our IP), 11 (Disclaimers), 12 (Liability), 13 (Indemnification), and 16 (Governing Law) survive termination.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice in the Service at least 30 days before taking effect. Your continued use after changes take effect constitutes acceptance. If you do not agree to the updated Terms, close your account.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Morocco, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service will be resolved in the courts of Casablanca, Morocco, unless you have mandatory consumer protection rights to bring claims in your local jurisdiction.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
